Welcome to mi Pantrē.

These Terms and Conditions govern your use of the mi Pantrē website and any purchase made through the website. By accessing or using our website, you agree to these Terms and Conditions.

1. About mi Pantrē

mi Pantrē is a pantry range by mi butter, offering carefully crafted food products designed to bring flavour, convenience and quality to everyday cooking.

All products are made and supplied in South Africa.

2. Products and Product Information

We make every effort to ensure that product descriptions, ingredients, photographs, weights, prices and other information displayed on the website are accurate and up to date.

However:

  • product photographs are intended as a representation and actual products may vary slightly;

  • colours may appear differently depending on your device or screen;

  • product availability may change without notice;

  • weights and measurements are subject to normal manufacturing tolerances; and

  • we reserve the right to correct genuine errors in product information or pricing.

We will not knowingly misrepresent our products or their characteristics.

3. Prices

All prices displayed on the website are in South African Rand (ZAR).

The price payable for an order is the price displayed at the time the order is placed, together with any applicable delivery charges.

Where applicable, promotions, discounts and special offers may be subject to additional terms and conditions.

We reserve the right to end or amend promotions at any time, subject to applicable law.

4. Placing an Order

When you place an order through the website, you are making an offer to purchase the selected products.

Your order will only be accepted once payment has been successfully received and we have confirmed the order.

We reserve the right to decline or cancel an order where:

  • a product is unavailable;

  • there has been an obvious pricing or product-description error;

  • payment has not been successfully processed; or

  • we reasonably suspect fraudulent or unauthorised activity.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order.

5. Payment

Payment must be made through the payment methods made available on the website.

We do not have access to or store your complete card details where payment is processed through a third-party payment provider.

Payment processing is subject to the terms and security measures of the relevant payment provider.

ECTA requires suppliers to use appropriately secure payment systems for electronic transactions.

6. Delivery

We deliver to the areas made available for selection at checkout.

Delivery charges and estimated delivery times will be displayed during the ordering process where applicable.

Delivery times are estimates and may be affected by circumstances outside our reasonable control, including courier delays, public holidays, severe weather, strikes or other disruptions.

Once your order has been dispatched, you may receive tracking information where available.

If an order is delayed or appears to have been lost in transit, please contact us so that we can assist.

7. Food Products, Storage and Handling

Our products are intended for consumption and must be stored and handled according to the instructions provided on the product packaging.

Customers are responsible for following:

  • storage instructions;

  • use-by or best-before dates;

  • refrigeration requirements, where applicable; and

  • any other instructions provided on the product.

Once a food product has been delivered, customers should inspect the packaging and store the product appropriately.

Do not consume a product if the packaging appears damaged, opened, tampered with or otherwise unsafe. Please contact us immediately if this occurs.

8. Allergens and Dietary Information

Ingredients and allergen information are provided on the relevant product packaging and/or product page.

Customers are responsible for checking the ingredient and allergen information before purchasing or consuming a product.

If you have a food allergy, intolerance or specific dietary requirement, please contact us before purchasing if you require clarification.

We cannot provide medical or dietary advice.

9. Returns, Refunds and Defective Products

Because mi Pantrē products are food products intended for consumption, we generally do not accept returns simply because a customer has changed their mind, particularly where a food product has been opened or where returning it would compromise food safety.

However, this does not limit any rights you have under South African consumer law.

The CPA provides consumers with rights relating to unsafe, defective or poor-quality goods. In particular, section 56 provides an implied warranty of quality and, where applicable, allows a consumer to return qualifying defective goods within six months and receive the applicable remedy.

If you receive a product that is:

  • damaged;

  • defective;

  • unsafe;

  • incorrect;

  • materially different from what you ordered; or

  • otherwise does not meet the applicable legal requirements,

please contact us as soon as possible with your order number and photographs of the product and packaging.

We will assess the issue and provide an appropriate remedy in accordance with applicable law.

10. Online Cooling-Off Rights

Certain electronic transactions may be subject to a statutory seven-day cooling-off right under ECTA. However, ECTA specifically excludes certain transactions involving foodstuffs and other goods intended for everyday consumption supplied to a consumer's home, residence or workplace, as well as goods that are likely to deteriorate or expire rapidly.

Accordingly, the applicable statutory rights will depend on the particular product and transaction.

Nothing in these Terms and Conditions is intended to exclude or limit a consumer right that cannot lawfully be excluded.

11. Damaged Deliveries

If your order arrives visibly damaged, please photograph the package and products before disposing of any packaging and contact us as soon as reasonably possible.

This will help us investigate the issue with the relevant delivery provider.

12. Product Availability

We make every reasonable effort to keep website stock information accurate.

If a product becomes unavailable after you have placed an order, we will contact you and, where appropriate, offer:

  • a suitable alternative;

  • a later delivery; or

  • a refund for the unavailable product.

13. Promotions and Discounts

Promotional offers are subject to availability and any specific promotional terms displayed at the time.

Unless expressly stated otherwise:

  • promotions cannot be exchanged for cash;

  • promotional offers cannot be combined; and

  • promotional pricing applies only during the stated promotional period.

14. Website Content and Intellectual Property

All content appearing on the mi Pantrē website, including:

  • logos;

  • product photography;

  • photographs;

  • written content;

  • graphics;

  • designs;

  • product names;

  • branding; and

  • other original material

is owned by or licensed to mi Pantrē / mi butter and may not be copied, reproduced, modified, distributed or commercially exploited without our prior written permission.

15. Website Use

You agree not to:

  • use the website for unlawful purposes;

  • interfere with the operation or security of the website;

  • attempt to gain unauthorised access to the website or its systems;

  • copy or reproduce website content without permission; or

  • use the website to conduct fraudulent activities.

We reserve the right to restrict or terminate access where reasonably necessary.

16. Privacy and Personal Information

We respect your privacy and process personal information in accordance with applicable South African data-protection legislation, including the Protection of Personal Information Act (POPIA).

Personal information may be collected and processed for purposes including:

  • processing and fulfilling orders;

  • processing payments;

  • communicating with customers;

  • delivering products;

  • responding to enquiries;

  • improving our products and website; and

  • sending marketing communications where permitted by law.

POPIA places specific requirements on electronic direct marketing and provides consumers with rights regarding unsolicited marketing communications.

  • new products;

  • special offers;

  • promotions;

  • mi Pantrē news; and

18. Website Availability

We aim to keep the website available and functioning properly but cannot guarantee uninterrupted or error-free access.

We may temporarily suspend the website for maintenance, updates, security reasons or circumstances beyond our reasonable control.

19. Limitation of Liability

Nothing in these Terms and Conditions excludes or limits any liability or consumer right that cannot lawfully be excluded or limited under South African law.

Subject to applicable law, mi Pantrē will not be responsible for losses arising from circumstances beyond our reasonable control, including delays caused by third-party delivery providers, network failures or other external disruptions.

20. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes to our products, services, website or applicable legal requirements.

The latest version will always be published on this website.

21. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with in accordance with applicable South African law and the consumer protections available to the customer.
